TURKISH REGISTRATION AGREEMENT

EP TRANSPORTATION ORGANIZATION TOURISM LOGISTICS INDUSTRY TRADE LIMITED COMPANY TOUR REGISTRATION AGREEMENT

ARTICLE 1: PARTIES

On one side, EP TAŞIMACILIK ORG.TUR.LOJ.SAN. ve TİC.LTD.ŞTİ., residing at Oran Mah. Kudüs Cad. NO: 6 /1 Interior Door NO: 15, Çankaya Ankara (hereinafter referred to as EKOTREND TOURISM TRAVEL AGENCY / Agency), and on the other side, the person making the reservation, whose address is mentioned above (hereinafter referred to as Reservation Owner / Participant / Guest / Customer / Reservation Owner / Passenger), have reached a full agreement on the matters mentioned below.

ARTICLE 2: SUBJECT

This agreement includes the customer's Tour / Hotel Registration Reservation through the Agency and the services for which the customer has received and/or may receive discounts, as explained below.

ARTICLE 3: IMPLEMENTATION

3-1) Passengers must carry their identity cards/passports during domestic/international tours. During the hotel/tour registration process, all participants must declare their date of birth, TC identity number, and contact information accurately and completely. The participant is responsible for all penalties arising from any incorrect declarations.

3-2) In air transportation, passengers accept that the flight time and aircraft type may change due to reasons arising from the airline company. It is considered that a special warning and information have been made at the time of the contract regarding this matter.

3-3) For tours including transport, the meeting time is half an hour before the departure time for bus transports and two hours before for flight transports. Participants must be present at the boarding/alighting points designated by the agency at the designated time and should not request different drop-off routes at the end of the tour. If the participant is unable to join the trip due to not being present at the departure point on time, they do not have the right to request a refund. In this case, the participant can join from the point where the tour is located by covering their own transportation costs.

3-4) Passengers participating in the tour are deemed to have given permission for the video and photo recordings made during the tour to be used by EKOTREND TOURISM TRAVEL AGENCY for advertising purposes, and for the evaluations and comments on the survey forms filled out after the tour to be used. Additionally, they are deemed to have given permission for email and SMS communications sent by EKOTREND TOURISM TRAVEL AGENCY for promotional purposes based on the information provided. The participant acknowledges, accepts, and undertakes that the agency is authorized to process all data (hereinafter referred to as 'Personal Data') provided and/or conveyed by the participant within the scope of the fulfillment of the contracted service, including but not limited to obtaining, recording, storing, preserving, modifying, reorganizing, classifying, sharing with administrative bodies and/or similar regulatory institutions for the purpose of auditing, and transferring to those assigned by the agency solely for fulfilling the contractual services, and that the participant's consent in accordance with the legislation has been obtained.

3-5) Discounts applied for the third person in 3-person bookings are valid only for accommodation in a 3-person room, and it is not guaranteed that the third person's accommodation bed will be a standard bed. The reservation owner is deemed to have accepted that the third bed in a 3-person room may be an extra bed.

3-6) Child age discounts are only valid in the presence of a minimum of 2 adults. Discounts for children accompanying 1 adult are not applicable and are calculated as 2 adults.

3-7) For tours with 11 - 16 participants, transportation is provided with a minibus, for 17 - 24 participants with a 27-person midibus, for 25 - 29 participants with a 31-person midibus, and for 30-53 participants with 46 or 55-person buses. The vehicle type to be used may change at the agency's discretion depending on the road conditions on the tour route. Seat numbers will be informed to the guest at the time of registration. The allocation of seats in the vehicles used for transportation may vary based on the capacity of the transportation vehicle (aisle - window). In case of a change in the type of vehicle, the agency reserves the right to change the seat numbers. In cases where a single seat is purchased, the agency reserves the right to change the seat and number if necessary.

3-8) The agency has the right to cancel the tour if the required number of participants for the tour cannot be reached, if force majeure events occur, or if unforeseen acute reasons are deemed to adversely affect the flow, content, quality, and safety of the tour. In such cases, if the agency cancels the tour, it will inform the reservation owner about the cancellation. In this case, all payments made by the reservation owner will be refunded. The refunds will be made in the same way as the payment method received during the reservation. Refunds for cash payments will be made in cash, refunds for payments made by credit card will be refunded to the credit card used for payment, and refunds for payments made by wire transfer will be made to the reservation owner by wire transfer. In credit card refunds, the time it takes for the refund to reflect on the reservation owner's card depends on the processing of the relevant bank. The agency cannot be held responsible.

3-9) EKOTREND TOURISM TRAVEL AGENCY may make changes to the content and date of the tour it deems necessary on its website, social media channels, and all written, visual, and digital platforms, as well as in the program documents issued to the reservation owner as an annex to the contract. The agency reserves the right to make changes to hotel changes, the sequence of the tour flow, guide, vehicle, restaurant, meal menus, route cancellations, or additions to the route, provided that the standard remains the same. The agency may make these changes before the tour as well as during the tour. Even after the tour has started, the guide has the right to make changes with the agency's knowledge and approval, if deemed necessary.

3-10) If the reservation owner is unable to attend the tour due to severe illness (with proof from a formal board report obtained from a fully-fledged state hospital) of themselves or a first-degree relative, or due to the death of a first-degree relative, they can transfer the reservation to a third party who meets all the necessary conditions for the tour or cancel it, provided that they submit a written and documented request. After the cancellation approval, the refund process will be carried out according to the refund conditions specified in the contract.

3-11) If the reservation owner cancels the agreement without any justified reason more than 30 days prior to the start of the tour, the entire contract price will be refunded; if it is canceled 30 - 15 days prior, 50% will be refunded; if it is canceled 15 - 7 days prior, 25% will be refunded. No refunds will be made for cancellations made less than 7 days before the start of the tour.

3-12) In domestic cultural tours where early booking discounts are applied, to benefit from the announced discount, at least 50% of the discounted price valid at the time of registration must be paid. The discounted price is fixed, and the reservation is finalized. Participants must pay the remaining balance in full at least 40 days prior to the departure date of the registered tour. Balances not settled by 40 days prior to the tour departure will be revised based on the applicable price at the time of payment. If there are no current discount campaigns 40 days before, the agency reserves the right to cancel the discounted price applied for that reservation. Any participant who has paid their balance 40 days prior benefits from an unconditional cancellation refund guarantee until 30 days before the tour departure. In cancellations requested 30 days before, the entire reservation amount will be refunded in the manner paid by the guest (credit card, wire transfer, or cash).

In the early booking period, if the reservation owner has purchased early cancellation travel insurance, the reservation owner can cancel the reservation (total cancellation of the reservation) at least 72 hours before the entrance date without any deduction of the insurance fee collected at the time the contract was signed, and the entire reservation amount will be refunded. In case of date change requests, the prices and availability conditions of the facility on the request date will apply. The guest accepts the price difference.

3-13) The reservation owner is responsible for tracking and controlling their belongings, and the agency has no liability for lost/stolen/damaged belongings during the trip, except in cases of gross negligence by the agency or its employees. In cases of theft or loss due to gross negligence of the agency or its employees, the agency will only compensate a maximum of 15% of the tour price per person. The agency cannot be held responsible for items forgotten in the tour vehicle. In cases where forgotten items can be found and delivered to the guest, the transportation costs will be borne by the passenger.

3-14) If the characteristics (such as age) of children who will stay free or at a discounted rate, as determined by the facility, are found to be inaccurate at the time of reservation, the reservation owner will immediately and completely pay for these children and will undertake all kinds of compensation. The reservation owner and accompanying participants will stay in the room type declared at the time of purchase, and cannot request to stay in a different room type upon hotel check-in. Reservation owners who stay with two or more children in the same room accept in advance the potential congestion that may occur due to the facility's room types. Benefiting from the service of the facility/hotel is a personal choice for each participant. It does not bind the content of the tour program. The policy of additional services charges by used facilities/hotels is not subject to agency penalties or faults.

3-15) Those who are not signing the contract, but whose names are mentioned in the contract (the ones for whom the reservation is made) and who participate in the tour are deemed to have granted authorization to the reservation owner/consumer who signed the agreement, they acknowledge that they accept all the terms of the contract as well as that the reservation owner's signature constitutes confirmation of these terms.

3-16) The reservation owner agrees to comply with any rules that the agency, guide, transportation vehicle, and facility officials/staff will communicate regarding the purchased tour and that they will respect the rights of other consumers and third parties. If they behave in a manner that disturbs them, they acknowledge that they will be removed from the tour and that they will not have any rights or claims against the agency.

3-17) The reservation owner has been informed and provided with the agency’s tour program and brochure, which includes the information about the tour they are contracting, and this documentation is attached to the contract. Additionally, detailed information regarding the tour has been provided at the time the agreement was made. The reservation owner states that they are familiar with the details of the tour contracted and that the tour program has been provided to them. The reservation owner is obliged to be knowledgeable about the tour program purchased. They are considered to have read the tour program in written form and visually. They cannot request changes to the content and route of the tour from the field staff, guide, or agency representatives during the tour. They accept and acknowledge the food and beverage information and menus stated in the tour program attached with the contract. The reservation owner is responsible for taking necessary precautions regarding their existing health problems. Requests for changes to the tour program can only be possible if all participants agree, and only with their written consents. It will be the discretion of the tour guide to decide on whether or not a vote will be held. The agency will provide briefings prior to the tour.

3-18) For entry into Georgia, a photo ID card (including infants) containing the TC Identity Number is required, and different identity cards (such as driver's licenses) will not be accepted. ID cards issued over 10 years ago (even if undamaged), worn-out, and those that do not feel the cold seal may not be used for entry. Entry will not be possible in such cases. In case of problems during entry procedures, the responsibility falls on the reservation owner. During special days, national and religious holidays, and festival periods, the agency cannot be held responsible for any delays caused by crowds and congestions at border crossings and tourist centers related to these situations.

3-19) The hotel is responsible for room allocation; therefore, the agency cannot directly intervene. Consequently, the agency cannot be held liable for the room allocated by the facility.

3-20) For international tours, a valid passport is required for passengers, including infants. Visa and passport procedures are entirely the responsibility of the reservation owner. In the event that a visa is not obtained, the visa fee paid to the consulate is not the agency's responsibility and cannot be demanded back from the agency. The cancellation and refund conditions for international tour sales may vary. The agency, as a sales representative for different operators in international tour sales, will accept the contract of the operator with whom it sells and will present it to the participants for their information and approval. The cancellation/refund conditions stipulated in the contract of the provider operator will be applicable.

3-21) If the agency fails to fulfill this package tour agreement due to its fault, or if the tour cannot be completed after it has begun due to a reason arising from the agency, or if it is determined that the service provided is defective, the agency will refund and compensate the participant according to the provisions of the travel insurance.

3-22) If the reservation owner wishes to leave the tour claiming that the service received is defective, they must inform the agency and the facility they are staying at in writing, explaining their reasons before leaving. Otherwise, they will be considered to have left the tour, and it will be deemed that they have used and benefitted from the service. It is the good faith customer’s duty to report any complaints about the service during its execution to the authorized person in writing. If the customer uses the service until the end without informing the agency representatives of their complaints, their rights such as substitute service and refund will be invalidated. The agency's ability to resolve the customer's potential problem and/or make the necessary explanation cannot be taken away. If the customer has not submitted their written complaint to the agency during or after the tour regarding the issues they are dissatisfied with, the agency reserves the right to respond, object, demand rectification publication, and claim damages without providing any opportunities for solving, examining, or answering the subject of complaint.

3-23) According to the Law No. 1618, if a package tour service is purchased, it is insured against situations such as the agency's bankruptcy, as well as not delivering the package tour at all or delivering it incompletely. The coverage of this insurance is equivalent to the package tour fee.

3-24) In resolving disputes arising from the contract, parties may apply to the TURSAB ARBITRATION BOARD as well as pursue other legal remedies.

3-25) The voucher and the attached registration form constitute the entire agreement; the Reservation Owner states that they have read the agreement and that they understand and accept the terms of the agreement when making this reservation.

3-26) The customer acknowledges that even if they cannot sign this reservation agreement via mail order, virtual POS, wire transfer, or EFT for any reason, they have learned the present agreement terms from the catalog, website, or advertisements, and they have pledged to accept the reservation under the written terms of this agreement.

3-27) The customer guarantees that they have received all the necessary information regarding the hotel, tour, and program mentioned in this agreement and has reviewed it, signed after reading this agreement.

3-28) The agency has announced the properties and star ratings of the accommodation facility and the services planned to be provided at the accommodation facility based on the facility's statements, brochures, and information on the facility's official website. The agency is not responsible for the accommodation facility's failure to meet the standards and star classifications mentioned in its declarations. In cases where the accommodation facility does not meet the proposed standards or is not in a position to provide services at that standard on the date the accommodation will begin, the agency is entitled to accommodate the customer at another facility of the same or higher category.

3-29) If the customer does not check into the hotel without canceling, the accommodation fee is non-refundable. In cases of compelling circumstances such as death, illness, or accident, the amounts for the days not stayed will be refunded upon documentation. Any other reasons for late check-in or early check-out will not be refunded.

3-30) If participants do not arrive at the designated departure points at the stipulated times without notice from the agency, their tour fees will not be refunded. Participants are responsible for being present at the time and place announced by the agency.

3-31) In situations where travel restrictions are imposed by government authorities, or a curfew is declared in the country, or a state of emergency is declared, the amounts to be refunded for canceled tours, except for mandatory taxes, fees, and similar legal obligations incurred and documented to third parties, will be refunded to the participant in full without any deductions within 15 days, starting two months after the lifting of the emergency state, curfew, and travel restrictions.

3-32) The participants are required to pay at least 50% of the reservation price at the time of registration, and the remaining balance must be paid at least 15 days before the service starts. If the specified payments are not made within the specified periods, the reservation will be canceled, and 50% of the service fee will be invoiced to the consumer as a cancellation indemnity. Even if an advance payment is made, participants who do not complete the tour fee by the specified dates but want to participate at the departure point will be at the agency's discretion regarding their participation. The agency is not obliged to include guests who have not completed their payments in the tour.

3-33) The agency may organize early booking campaigns. It reserves the right to determine and change the discount rates and duration of these campaigns. If deemed necessary, it may cancel the campaign. During the season, it may organize promotions/discount campaigns for certain products for specific periods. The discount amount applied during the early booking period cannot be claimed from the guest, and it is also considered that any price differences arising from possible actions will not be compensated by the agency.

3-34) For consumers who purchase travel insurance services, the scope of coverage for incomplete or defective performance, damage, illness, loss, and claims are determined by the policy of the insurance company that provides this service. The agency has no responsibility regarding the content, scope, or application of these coverages.

3-35) In airfares, the airline's rules apply in case of baggage loss or damage, and the consumer explicitly agrees that this is not the agency's responsibility.

3-36) Requests for early check-out made by the customer after the commencement of the accommodation/tour/activity will be evaluated based on the approval of the service provider. In case of early departure, whether a refund will be made or not is at the discretion of the cooperating provider; no objection can be raised to the agency regarding this and any penalties imposed will be billed as accommodation fees.

3-37) The customer is required to report any dissatisfaction regarding the facilities used during their accommodation/activity first to that facility and later to name that facility as the opposing party in any lawsuits or complaints they may file. Under no circumstances will they make any claims for material or moral damages through the agency.

3-38) The mandatory travel insurance requirement applies for domestic accommodation tours. For day trips or international tours, the responsibility lies with the guests. The coverage of the travel insurance is limited to the tour date. The coverage ends at the end of the tour date. The coverage of the mandatory travel insurance must be reviewed by the participant, and the participant must comply with the contents of the relevant policy. The agency has no responsibility for matters not covered by the insurance company.

3-39) Guests acknowledge that they are responsible for all consequences arising from any walking, climbing, or using vehicles included in the tour program.

3-40) The reservation owner is deemed to have accepted the participation conditions announced by the agency regarding the tour through this contract.

3-41) All airline ticket reservations made along with hotel/tour accommodations, including all categories (promotional, economy, business class) (including in cases of force majeure) are subject to the cancellation conditions of the relevant airline/TCDD. In cancellations pertaining to hotel/tour tickets including airplane/train tickets, the rules regarding cancellation will be valid excluding the airfare/train fare.

3-42) If participants personally procure their flight tickets, whether using miles/points or direct payment; if the agency cancels the tour, the agency will not be held responsible for any resulting damages.

3-43) The customer accepts and undertakes that they do not have any symptoms of infectious diseases and will conduct the necessary checks and tests before the tour. The agency has made all necessary warnings and taken precautions regarding infectious diseases; however, as the tour program will involve visiting many locations and staying at hotels, it is not possible for the agency to ensure precautions at these locations. Even with all possible precautions, it may not be feasible to prevent infectious diseases, and what is paramount is that the customer takes individual measures against such diseases, including physical distancing, no contact, hygiene, and mask usage. For all these reasons, the agency has no responsibility for any infectious diseases that the customer may contract during the tour, and the customer agrees that they will not demand any material or moral compensation from the agency, acknowledging and accepting all these issues prior to joining the tour.

3-44) This protocol has been drawn up in two copies and signed; disputes arising from the protocol shall be resolved by the Courts of Ankara.

3-45) The customer has read and accepted the notifications regarding the services related to their reservation based on the information provided to them by the agency.
